One land transfer tax, and where a Peel dispute is heard

The facts below are the ones that differ for a Mississauga purchase, taken from the province, the City of Toronto and the Superior Court's own published material.

  1. No municipal land transfer tax

    A Mississauga purchase attracts the provincial land transfer tax and nothing municipal. The municipal tax is a taxing power granted by the City of Toronto Act, 2006 and it reaches property in the City of Toronto, which is the only municipal land transfer tax the province names on its own land transfer tax page.

  2. What that is worth

    On a $900,000 home with one or two single family residences, the provincial tax is $14,475. The identical purchase inside Toronto attracts that same $14,475 plus a municipal $14,475, for $28,950. The saving is the whole of the second tax, and it grows with the price.

  3. The first-time buyer refund still applies

    The provincial refund of up to $4,000 works the same way here, so a qualifying first-time buyer at $900,000 pays $10,475. There is no second municipal rebate for the simple reason that there is no second tax to rebate. The refund can be claimed for up to 18 months after the transfer if it was missed on closing.

  4. Buyers who are not citizens or permanent residents

    The provincial Non-Resident Speculation Tax of 25 per cent applies across Ontario, including Mississauga. Toronto's additional 10 per cent municipal speculation tax does not, because it is a City of Toronto charge on Toronto property.

  5. Registration is electronic

    Ontario transfers are registered through Teraview, the province's electronic land registration system, and the province's land transfer tax statements are built into it. Nobody attends a counter to close a house, which is why your lawyer's location matters far less than whether they do this work daily.

  6. If something goes wrong after closing

    The Ministry's court directory lists no courthouse in Mississauga. Peel matters are heard at the Brampton courthouse, which the Superior Court's own practice direction names as the Peel Region Courthouse, in its Central West region. A claim of $50,000 or less goes to the Small Claims Court there.

On a $900,000 home the Mississauga bill is $14,475 against $28,950 in Toronto, because Toronto charges a municipal land transfer tax that matches the provincial ladder up to $2 million and climbs past it above $3 million. The gap is the single largest closing cost difference between the two cities and it widens as the price rises.

Do I need a lawyer to close a purchase in Mississauga?

For practical purposes, yes. Ontario transfers are registered electronically through Teraview and the province's land transfer tax statements form part of that registration, and any institutional lender will require a lawyer to certify title and receive the mortgage advance. What varies between quotes is how much of the file the fee actually covers.

What is the first-time buyer refund worth here?

Up to $4,000, which is the full provincial tax on the first $368,000 of the price. On a $900,000 purchase that brings the tax from $14,475 to $10,475. To qualify you must be at least 18, occupy the home as your principal residence within nine months of the transfer, and never have held an ownership interest in an eligible home anywhere in the world. I am buying a condo in Mississauga. What is a status certificate?

It is the condominium corporation's disclosure package: its financial position, the state of the reserve fund, any special assessment being contemplated, the declaration and rules that will bind you, and whether the unit's common expenses are in arrears. Reviewing it is separate work from the closing and should be quoted as such.

If there is a problem after closing, where would a claim be heard?

At the Brampton courthouse, which serves the Region of Peel and sits in the Superior Court's Central West region.
